Family, including 2-year-old, hit by suspected DUI driver near Strip files lawsuit

A mother, father and 2-year-old girl filed a lawsuit Thursday against Tesla and the DUI suspect accused of injuring them in a crash near the Strip.
Luke, Jessica and Isla Sadler were visiting from the United Kingdom when, on the evening of Feb. 8, a Tesla authorities say was driven by Gavin Caci, 28, struck them near East Harmon Avenue and Audrie Street.
The mother and child were taken to University Medical Center and diagnosed with brain bleeding, authorities have said. Luke Sadler suffered ligament damage and soft tissue damage to the elbow, according to prosecutors, who said Thursday that the child also suffered a skull fracture and broken femur and that her mother remained unable to walk.
Prosecutor Corey Hallquist said Caci’s Tesla filmed the crash. He alleged that Caci also had a high blood alcohol content at the time. Hallquist and Las Vegas Justice of the Peace Joe Bonaventure both indicated it was 0.22 percent, nearly three times the legal limit.
Caci’s defense attorney Paola Armeni did not immediately comment on the lawsuit. But in court, Crane Pomerantz, another lawyer for Caci, argued that video did not “depict someone driving like a nut,” and said Caci apologized for being in his situation ”without admitting any guilt.”
Plaintiffs’ attorney Al Lasso said in the suit, filed in state court, that Caci failed to maintain his travel lane. His car drove onto the sidewalk, hit another vehicle and a Nevada Energy power box and “violently struck” the Sadlers, according to the complaint.
“Mounting a sidewalk at a marked urban intersection, striking multiple objects, and continuing forward into a family with an infant demonstrates conduct far beyond ordinary negligence,” the suit argued.
Tesla and Tesla Lease Trust, which the suit said owned the car in the crash, are also named as defendants. The complaint said the Tesla entities were negligent, too.
Tesla Lease Trust knew or should have known that Caci was a dangerous driver and Tesla’s driver-assist system was defective and made the car “unreasonably dangerous,” according to the filing.
Tesla did not respond to a request for comment.
