NAACP plans to sue Elon Musk’s xAI over unpermitted gas turbines polluting air in South Memphis
The National Association for the Advancement of Colored People (NAACP) has issued a formal notice of intent to sue Elon Musk’s artificial intelligence startup, xAI, over alleged violations of federal environmental laws tied to the company’s data center operations in South Memphis, Tennessee.
The notice, sent Tuesday through the Southern Environmental Law Center (SELC) on behalf of the NAACP, accuses xAI of operating methane gas turbines at its Memphis data center without securing the necessary permits or installing the “best available” pollution controls required under federal law.
“These turbines have pumped out pollution that threatens the health of Memphis families,” said SELC Senior Attorney Patrick Anderson. “This notice paves the way for a lawsuit that can hold xAI accountable for its unlawful refusal to get permits for its gas turbines.”
According to the SELC, xAI had installed 35 gas turbines at the site, nearly all of which were operating without permits as of April. While the company has since removed some smaller units, it has reportedly installed three larger turbines in their place.
Data centers powering artificial intelligence are notoriously energy-intensive and require uninterrupted electricity. In the absence of sufficient clean energy infrastructure, the rising demand is increasingly being met with fossil fuels, including methane-based natural gas. Methane, while shorter-lived in the atmosphere than carbon dioxide, is considered significantly more potent as a greenhouse gas.
Memphis, a city already struggling with poor air quality, faces additional environmental strain from emissions produced by xAI’s facility, the SELC said. The group first raised concerns in August 2023 when it reported that xAI had installed 20 gas turbines at the location.
